2. Purpose and PAIA guide
This manual describes categories of records held by Lexicor and how to request access. Under section 50 of PAIA, access to a private body's records is generally subject to the record being required to exercise or protect a right, compliance with the prescribed procedure and applicable grounds of refusal.
The Information Regulator's guide, prescribed forms and information about fees and remedies are available from the Information Regulator's PAIA resources.
3. Records held by Lexicor
Depending on our activities and instructions, records may include:
- Corporate and trust records: statutory registers, resolutions, company or trust particulars, ownership information, supporting documents and filings.
- Client records: mandates, correspondence, quotations, instructions and administrative records.
- Business records: accounting, tax, contracts, supplier records and statutory compliance information.
- Website and communications records: enquiries and limited operational or security records.
Records may be held or processed in connection with the Companies Act 71 of 2008, Trust Property Control Act 57 of 1988, POPIA, PAIA, applicable tax legislation and other laws relevant to a particular matter. Listing a category does not establish that every record exists or that it may be disclosed.
4. Information available without a formal request
Our publicly available website pages, service descriptions, Knowledge articles, Privacy Policy, Terms of Use and this manual may be accessed without submitting PAIA Form 2. Other records are assessed under the applicable legal access process. No additional categories are designated for automatic disclosure under section 52 in this manual.
5. Personal-information processing
Purposes: Enquiries, client engagement, company and trust secretarial administration, statutory filings, correspondence, accounting, legal compliance and website security.
Data subjects and information: Clients and representatives (identity, contact and instructions); directors, shareholders, beneficial owners, trustees and beneficiaries (identity, ownership or trust-related records); advisers and suppliers (business contact and transaction records); and website visitors (enquiry and limited technical security information). Special personal information and children's information may be processed where lawfully required for a matter.
Recipients: Authorised clients and representatives, professional advisers, statutory or regulatory authorities, and providers supporting business administration, communications, document management, hosting and security, where relevant and lawful.
Cross-border processing: Certain electronic services may involve processing outside South Africa. Relevant transfers are subject to the conditions in section 72 of POPIA.
Security: Lexicor uses risk-appropriate administrative and technical safeguards, including access controls and measures to protect website enquiries. Safeguards are reviewed in light of the information concerned and operational risks.
See our Privacy Policy for information about individual rights and privacy requests.
6. How to request a record
- Complete PAIA Form 2 (Request for Access to Record), available from the Information Regulator.
- Identify the record and explain the right you wish to exercise or protect and why the record is needed.
- Include your contact details and, if acting for someone else, proof of authority.
- Email the completed request to info@lexicor.co.za, marked PAIA Request — Information Officer.
We may verify identity or authority and will consider any applicable protection of third-party information or other lawful grounds of refusal. The ordinary decision period is 30 days, subject to lawful extensions. Prescribed fees, exemptions and access charges may apply; the Information Officer will advise where payment is lawfully due. Current fees and forms are published by the Information Regulator.
7. Decisions and remedies
If access is refused in whole or in part, reasons and available remedies will be communicated as required by law. There is ordinarily no internal appeal for a private body. A requester may, where applicable, lodge a complaint with the Information Regulator or approach a court, subject to PAIA's requirements.
